Here you will find a comment letter submitted to the U.S. Department of Education (ED) in response to ED's Notice of Proposed Rulemaking on the issue of significant disproportionality under the Part B of the Individuals with Disabilities Act (IDEA) in special education. Our letter urges ED to issue final regulations that will help ensure that states act to eradicate discriminatory practices that perpetuate significant disproportionality including employing a standard formula for determining significant disproportionality and ensuring implementation of evidence-based interventions like positive behavior interventions and supports.
